Killer fights state's effort to keep him locked up

FORT EDWARD, N.Y. (AP) -- A western New York man who killed his family and a neighbor nearly 30 years ago has taken the state to court over its effort to keep him imprisoned after his sentence ends next year.

The Post-Star of Glens Falls reports that 46-year-old John Justice filed his lawsuit in Washington County because that's where he's serving his 30-year sentence at a maximum-security prison.

State lawyers say Justice is mentally unfit and want him held in a secure mental institution after he's released from prison. His lawyer says the state is violating Justice's constitutional rights by trying to hold him in custody after his sentence has ended.

Justice was 17 when he killed his parents and younger brother in Kenmore in 1985. He killed a neighbor in an intentional car crash after stabbing his family to death.
