Wandering Dago heads to Federal Court

UPDATE: ALBANY - The owners of a controversial food truck took their case to federal court Thursday.

The judge still deciding if the Wandering Dago Truck can operate at the Empire State Plaza.

The Office of General Services says they have the right to deny their application to serve food on the property, while owners of the truck say they just want to get back to work for the remainder of the season.

ALBANY -- A federal judge in Albany is being asked to decide a case involving a food truck banned from operating at both the Empire State Plaza and the Saratoga Race Course.

The owners of the "Wandering Dago" say the name was chosen to honor their Italian heritage.

But the office of general services says allowing the truck at the Empire State Plaza would expose thousands of state workers to offensive language, and the New York Racing Association says it ordered the truck removed when it got complaints.

The owners contend their right to free speech has been breached.
