GLOVERSVILLE -- The man known in the Gloversville community as "Mr. Ding-A-Ling has been relieved of his duties after being arrested for DWI while driving his ice cream truck.

According to Fulton County Sheriff, Thomas Lorey, 53 year-old Phil Hollister was arrested early Saturday morning. Hollister swerved his ice cream truck into the on coming lane, almost taking out a police vehicle, Lorey said.

"He saw the ice cream truck come into his lane and he immediately got off to the shoulder turned around and followed the truck until he got him stopped," Lorey said of the sheriff deputy.

Hollister was cooperative and took the field sobriety tests. Hollister blew a .15 said Lorey.

Gloversville Mayor Dayton King says the Mr. Ding-A-Ling truck will keep its permit for the city as long as Hollister is not driving it.

Mr. Ding-A-Ling was recently in a lengthy court battle with rival ice cream truck operator Sno Kone Joe over the permit for the City of Gloversville. The court ruled Mr. Ding-A- Ling could keep his permit.
